OPINION
Kristy Beets and Glenn Allen Rose (plaintiffs) the parents of Glenn Patrick Rose filed a lawsuit action consistent(predicate) to 42 U.S.C 1983 that deputy spend used excessive surprise when he shot and killed Glenn. The actions were dismissed on premise the pursuant to Heck v. Humphrey, 512 U.S. 477.114 S.Ct.2364, 129,L.Ed.2d 383(1994) The conviction of Glenns friend.
ISSUE
Parents Allege that a police officeholder (Deputy Winter) used excessive force when he shot and killed their son. The officers actions were deemed deep down his scope of employment in the trail of his accomplice. Any finding of fact in the parents favor would undermine the courts previous decision against Ms. Morales.
FACTS
On May 13, 2008 Mr. Rose and Ms. Morales fled from Los Angeles Sheriffs California Highway Patrol. Mr. Rose and then parked his white Honda in a alleyway and ran and entered a abandoned pickup hand truck. An altercations took place when three police officers attempt to arrest Mr. Rose and his companion. They then started the truck and were able to squeeze away. Mr. Rose did not go far before ramming into a California Highway Patrol car. While driving the truck in reverse Mr.



Rose was in a put path of Deputy Winter. Deputy Winter fired at Mr. Rose and killed him. Testimony will show that Deputy Winter was in fact in fear of his life.
